Terms of Service

These Terms of Service ("Terms") are a binding agreement between you, the parent or legal guardian creating the account ("Parent", "you"), and PhonicsLogic ("PhonicsLogic", "we", "us"). By creating an account or using PhonicsLogic, you agree to these Terms. If you do not agree, do not use the service.
1. Who may use PhonicsLogic
You must be at least 18 years old and the parent or legal guardian of any child learner you add. You are responsible for supervising your child's use of PhonicsLogic and for all activity on your account.
2. Accounts and child learner profiles
You agree to provide accurate information when creating your account and to keep your password secure. You may add one or more child learner profiles consistent with your subscription plan. You consent to our collection and use of limited information about your child as described in the Privacy Policy, solely to operate the learning program.
3. Subscriptions and billing
- Paid plans are billed in advance by our payment processor (Whop) on the cadence shown at checkout (e.g. monthly or annual).
- Subscriptions renew automatically until cancelled. You can cancel at any time from your account; cancellation takes effect at the end of the current billing period.
- Free trials, if offered, convert to a paid subscription at the end of the trial unless cancelled beforehand.
- Except where required by law, fees are non-refundable. We may issue refunds at our discretion.
- We may change prices on a going-forward basis with at least 30 days' notice to active subscribers.
4. License
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use PhonicsLogic for the personal, non-commercial educational use of your household.
5. Acceptable use
You agree not to:
- Share, resell, or sublicense your account or content from PhonicsLogic.
- Attempt to bypass authentication, rate limits, or security controls.
- Use automated tools to scrape, copy, or download curriculum content.
- Upload unlawful, harmful, or infringing content through journal entries or feedback.
- Use the service in a way that violates any applicable law, including child-protection laws.
6. Intellectual property
PhonicsLogic, its lessons, curriculum, illustrations, audio, code, and branding are owned by PhonicsLogic or its licensors and are protected by intellectual property laws. Journal entries and feedback you submit remain yours, but you grant us a worldwide, royalty-free license to use them solely to operate, secure, and improve the service.
7. Suspension and termination
We may suspend or terminate access to PhonicsLogic if you breach these Terms, abuse the service, or fail to pay. You may stop using the service and delete your account at any time. Sections that by their nature should survive termination will survive.
8. Disclaimers
PhonicsLogic is an educational supplement and not a substitute for professional reading or learning-disability assessment. The service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law.
9. Limitation of liability
To the maximum extent permitted by law, PhonicsLogic will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or related to your use of the service. Our total liability for any claim relating to the service will not exceed the amount you paid us in the 12 months before the claim.
10. Indemnification
You agree to indemnify and hold PhonicsLogic harmless from claims arising out of your breach of these Terms, your misuse of the service, or content you submit.
11. Changes to the service or Terms
We may modify the service or these Terms from time to time. If we make a material change, we will notify Parents by email or in-app notice before the change takes effect. Continued use after the effective date constitutes acceptance.
12. Governing law
These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws rules. Disputes will be resolved in the state or federal courts located in Delaware, and you consent to their personal jurisdiction.
